PENGATURAN MENGENAI HADHANAH DALAM HUKUM ISLAM DAN RELEVANSINYA DENGAN PERLINDUNGAN HAK-HAK ANAK DALAM KELUARGA

The research aims to examine the regulations regarding hadhanah in Islamic law and their relationship to legal protection of children's rights. This research uses a literature review method. In conducting a literature review, organized and directed steps are taken to collect, filter and analyze data in order to obtain credible conclusions. The results of the research show that there are two crucial problems regarding child care after divorce, namely, both parents, both husband and wife, both want custody of the child, resulting in a struggle for custody, and conversely, no one takes care of the child after divorce because the parents shift responsibility to each other, which has a negative impact on the psychological, welfare and educational aspects of the child. The legal basis for hadhanah is found in QS al-Baqarah/2:233 that it is still the mother's duty to breastfeed a child who is not yet two years old, while the father is obliged to provide for the child. The age limit for hadhanah is when the child is mumayyiz and able to take care of his own basic needs.
