ANALISIS AKAD JU'ALAH DALAM HUKUM ISLAM MENGENAI PRAKTIK JASA PENAGIHAN DI PT. MANDIRI TUNAS FINANCE DAN PT. PUTRA TIMAFLO BERSAUDARA

The application of the Ju'alah contract in the practice of billing services in collaboration between PT. Mandiri Tunas Finance and PT Putra Timaflo Brothers. The focus of the study is directed at job security, certainty of rewards, and compliance with applicable regulations. The research method used is a juridical-normative approach by analyzing fiqh literature, DSN-MUI fatwas, and cooperation contract documents between the two institutions. The research results show that billing practices have fulfilled the element of job security, determining compensation still creates uncertainty because it was not clearly agreed upon at the beginning of the contract. Rewards are determined based on the real costs incurred by PT. Putra Timaflo Bersaudara after the billing process is complete, thus opening up the opportunity for disagreement between the parties. This practice has the potential to contain elements of gharar which is contrary to sharia principles.
