ANALISIS PENGATURAN BATAS USIA PERKAWINAN BERDASARKAN HUKUM ISLAM DAN PERUNDANG-UNDANGAN

Differences in opinion among scholars in the science of jurisprudence and legislation regarding the age limit for marriage. This is normal because every individual in Islam has the authority to carry out ijtihad or work alone or in a group to gain an understanding of a legal provision. What is different is not the legal source itself, namely the Al-Quran and the Sunnahs of the Prophet Muhammad SAW, but the different methodologies for drawing legal conclusions. The method used is the library research method, where this method is a method related to collecting data by reading, studying, analyzing and processing using this library method which places more emphasis on descriptive, theoretical and philosophical analysis and does not require going into the field to collect data. According to Islamic law, it does not regulate absolutely the limits of marriage, and there are no specific rules regarding this matter. But Allah indicates that the person who will enter into a marriage must be someone who is ready and mature, not only that, according to several opinions of the ulama, someone who will enter into a marriage must be mature and mature. Apart from that, based on Article 7 paragraph (1) of Law Number 16 of 2019, it is clear that there has been a change in the age limit for marriage in Indonesia from the previously regulated marriage age for women at 16 years and for men at 19 years. So now the marriage age for men and women is 19 years old. If someone wants to have a marriage recognized and valid in the eyes of the law, then they must fulfill the applicable requirements, for example if someone wants to enter into a marriage, they must be 19 years old for both a woman and a man. However, if both of them still insist on carrying out the marriage for several urgent reasons, then the bride and groom may apply for a dispensation to the court as long as it must be accompanied by sufficient evidence, this is as stated in article 7 paragraph 2 of Law Number 16 of 2019.
